Websites4Contractors

These are the terms for using Websites4Contractors, the directory of contractors at websites4contractors.com. They are an agreement between you and TRESYN LLC, a California limited liability company, which owns and runs Websites4Contractors. In these terms, "we", "us" and "our" mean TRESYN LLC, and "the directory" means Websites4Contractors.

We have written them in plain words on purpose. If anything is unclear, write to support@websites4contractors.com and we will explain it.

The short version

This summary is here to help you. If it and the full terms below ever differ, the full terms are what count.

  • A listing is for one real business, based in the United States, that works for homeowners and has its own website.
  • You tell us three things about the business when you list it. They must be true.
  • Our servers read your website to check it before a listing is published and when you edit it, and may check it again while it is published.
  • A paid listing costs $79 a year on Basic or $149 a year on Pro, plus sales tax where your state charges it.
  • A paid listing renews automatically every year until you cancel.
  • For 30 days after you first pay for a listing, Cancel + Refund gives you that listing's price back.
  • Pro listings are shown before Basic listings. That order is not a rating, and we do not promise visitors, calls or search ranking.
  • While payments are closed you can publish a free Founding listing. Section 13 says how that ends.

1. Agreeing to these terms

You agree to these terms when you create an account, agree to them in your account, publish a listing, or pay for one. If you do not agree, please do not use the directory.

If you create an account for a business, you agree for that business, and you confirm that you are allowed to. You must be at least 18 years old.

If you only visit the public pages, the parts of these terms that apply to you are section 10 (what is not allowed), section 16 (what the directory is, and is not), section 17 (limits on what we owe you) and section 20 (law and disputes).

2. Who the directory is for

The directory lists businesses that:

  • do construction, repair or home improvement work in one of the trades on our category list;
  • have homeowners as normal customers, who can hire or buy from the business directly;
  • are based in the United States; and
  • have a real company website of their own.

It is not for businesses that sell only to other businesses or only wholesale, for businesses outside the United States, or for a business whose only place on the web is a social media page, a link page, or a profile on a review, lead or directory site.

If you list a business for someone else. Marketing agencies and others may list a client's business. If you do, you confirm that the client has agreed to the listing and to these terms, and you are responsible for the listing as if the business were your own.

3. Your account

  • You log in with an email address and a password. Keep your password to yourself. You are responsible for what is done in your account.
  • Keep the email address on your account up to date. We send notices about your listings, your payments and these terms to that address, and a notice counts as given on the day we send it.
  • One account is enough for any number of listings. You may not open another account to get around a limit in these terms.
  • If you think someone else has used your account, tell us at support@websites4contractors.com.

4. Your listing

One listing is one business. A listing is for one business, for as long as the listing exists. You may correct the business's name, or show its new name if the business is renamed. You may not turn a listing into a listing for a different business by editing it. A different business needs its own listing.

True and current. Everything in a listing must be true, and you must keep it current: the business name, town and state, phone number, website, description, services, hours and photos.

Its website. The website on a listing must be the business's own working website. One website address can be on only one published listing. If two accounts try to list the same website address, the listing published first keeps it.

If someone else listed your website. If your business's website is on another account's listing, you can ask us in writing to release it. Write to abuse@websites4contractors.com, name the listing, and send something that shows the website is your business's own, such as an email from an address that ends in the website's name. We may ask for more. If we are satisfied it is yours, we take that listing down (section 14), and the website is then free for your own listing.

Its categories. A listing may claim only categories for trades the business really does. A Basic listing has one category. A Pro listing has its main category and up to two more. We do not check which trades a business does, so we rely on you. If we learn that a listing claims a trade the business does not do, we may remove that category or take the listing down (section 14).

Editing it. You can edit your listing at any time. A change that would show on your public page is checked first (section 6). If a change does not pass, we hold it, and your page keeps showing the earlier version until you fix it.

5. The three statements you make

Before a listing can be published, you confirm three statements about the business:

  1. Homeowners are normal customers of this business.
  2. Homeowners can hire or buy from this business directly.
  3. This is a US-based business.

We keep a record of the statements with the date, the time and the account that made them. If you change the website on a listing, we ask you to make them again.

If a statement is false. Nobody at Websites4Contractors reviews each business by hand, so we rely on these statements. If any of them is false, or stops being true, we may take the listing down, and you are not owed a refund for it. If false statements are repeated or deliberate, we may also close the account (section 14).

If your business changes so that one of the statements is no longer true, take the listing down or tell us at support@websites4contractors.com.

6. The checks we run on your website

Your permission. By putting a website on a listing, you confirm that it is the business's own website, and you give us permission to visit it and read its public pages automatically, as often as these checks need. Our servers read only what any visitor can see.

When we check. We check the website:

  • before a listing is published, and again before you publish or pay if more than 24 hours have passed since it last passed;
  • when you edit the listing;
  • before each yearly renewal of a paid listing (section 12); and
  • while the listing is published, where we may check it as often as once a day. We call this the daily health check.

What we look for. Before a listing is published, when you edit it and before it renews, all of these must be true:

  • the website answers over a secure connection (its address starts with https) and does not send visitors on to a different website;
  • it has real content: it is not a parked page, a placeholder or an empty page;
  • it shows a United States phone number;
  • it gives visitors a way to contact the business: a phone number, a contact form, or an email address at the website's own name;
  • it names a place in the United States, a street address or a service area, that matches the town and state on the listing; and
  • it is not a stand-in for another website: it does not tell search engines that its real address is somewhere else, and it is not a thin page whose links all lead to one other site.

The daily health check looks at the first two only.

The words in your listing. We also check the words in a listing automatically. A listing is refused if it uses words on our blocked lists, such as words used to sell links, gambling, adult content, online pharmacies or payday loans; if it uses swear words or slurs; or if its website address is a link shortener, a social media or directory page, or a bare number address.

If a check fails. A listing that fails cannot be published, and you are not charged. We tell you which check failed and what to change, and you can run the checks again. A check that cannot finish because your website is slow to answer, or cannot be reached, counts as a fail until it passes. A check that cannot finish for any other reason is not a pass. Other reasons include a problem on our side, or your web host (the company that runs your website) turning our check away. Until a check passes, the listing cannot be published, and held changes are not shown. If your web host turns our check away, we tell you in your account. A person may then check your website by hand, and they read only what any visitor can see.

If you think a check got it wrong. Write to support@websites4contractors.com and a person will look at it.

What a pass means. A pass means your website passed those automatic tests on that day. It is not a review of your business, and you may not describe it as our approval or recommendation.

Our record. We keep a record of what your website answered and the result of each check.

If the daily health check fails two days in a row, we pause the link. Your listing stays in the directory, but its page stops showing the link to your website, and we email you what failed. A day when your website cannot be reached, or does not answer in time, counts as a failed day. A day when your web host turns our check away counts as neither a failed day nor a passing one. If that happens three days in a row, a person looks at your website. When a later check passes, the link comes back on its own.

A paused link is not a takedown and not a refund. Your listing stays up. Your subscription keeps running. Your paid year is not made longer, and no money is returned for the days the link was paused. A listing with a paused link still counts toward your volume discount.

8. Photos

A listing can have up to five photos.

What photos show. A listing's photos show the business's own work, team, vehicles or premises.

What a photo may not do. A photo may not:

  • promote another business, or pass off another business's work as yours;
  • carry a web address other than the listing's own website; or
  • be an advertisement for anything other than the listed business.

What is fine. Your own business name, phone number and website on your truck or sign are fine. So are marks that are only there in passing: a maker's label on materials, a vehicle maker's badge, a street sign.

Your right to use them. Post only photos you have the right to use: photos you or your business took, or photos whose owner has given you permission. Do not post photos copied from another website.

People and property in photos. You are responsible for having any permission you need from people who can be recognized in your photos, and from customers whose property is shown. If someone tells us they appear in a photo, or that it shows their home, and asks us to remove it, we may remove it.

We do not check photos before they appear. If someone reports a photo to abuse@websites4contractors.com, we look at it, and we may remove the photo or take the listing down (section 14).

9. Your content, and our permission to show it

You keep ownership of everything you put in a listing: your words, your photos and your business name.

To run the directory we need your permission to use that content. You give TRESYN LLC a license, which means legal permission, to store, copy, resize, format and publicly show your listing content on Websites4Contractors; to let it appear where our pages are carried or previewed, such as search engines and links that people share; and to show your listing, as it appears publicly, when we tell people about the directory.

This permission is free of charge. It is not exclusive, which means you can use your content anywhere else. It applies worldwide, because the web does. It lets us use the companies that host and deliver the directory for us.

The permission lasts while the content is in your account. When you remove content, or a listing comes down, we stop showing it on our pages. Copies may remain for a time in backups. Search engines and other websites may keep their own copies, which we do not control.

You confirm that you have the right to give us this permission, and that your content does not break the law or anyone else's rights.

10. What is not allowed

You may not:

  • give false or misleading information in a listing or in the three statements;
  • list a business you are not allowed to act for;
  • list a website that is not the business's own, or change the listed website, or where it leads, so that it no longer matches what passed our checks;
  • post content that is unlawful; that copies someone else's work or uses their trademark without permission; that is defamatory, which means a false statement that harms someone's reputation; that is hateful or sexual; or that advertises gambling, adult services, link selling, online pharmacies or payday lending;
  • try to get around our checks or our limits, including by opening more than one account;
  • use the directory to send spam, or collect information from it in bulk with automated tools. Search engines indexing our pages in the normal way are welcome;
  • interfere with the directory, probe it for weaknesses without our written permission, or try to reach accounts or records that are not yours; or
  • say or suggest that Websites4Contractors has reviewed, approved or recommended your business.

11. Plans, prices and the order of listings

Two plans. Basic is $79 a year. Pro is $149 a year. Both are paid once a year. We add sales tax where your state charges it. The price you pay is the one shown in your cart before you pay.

What every listing gets. Its own page in the directory with your business details, a description, your services, and your hours and photos if you add them; a link to your website; and the checks in section 6. A paid listing also has Cancel + Refund for its first 30 days (section 12).

What Pro adds. A Pro listing is shown before every Basic listing wherever businesses are listed, and it can appear in up to three categories instead of one. It still has one page.

The order of listings. Pages list the higher plan first: Pro listings, then Basic listings. Inside each plan, the business that has been listed longest comes first. The order is not a rating of any business. Beyond that order, we do not promise any position on a page, any amount of traffic, any number of calls or leads, or any result in a search engine. Search engines decide for themselves whether to show a page and how to treat a link.

Volume discount. If your account has five to nine listings, each one is 15% off. With ten or more, each one is 25% off. The count is every active listing on your account plus the listings in your cart, and your cart shows the discount before you pay. A listing is active while it is paid for, including while its link is paused. A Founding listing does not count until it is paid for. A listing that has been refunded or taken down does not count.

Changing plan. To move a listing from one plan to the other, write to support@websites4contractors.com. We will tell you what it costs or saves before anything changes. A Pro listing that moves to Basic keeps its main category and loses the other two.

While payments are closed. There are times when our checkout is closed, including when the directory first opens. Our pricing page says whether payments are open. While they are closed, you cannot buy a plan, Pro is not available, and the only listing you can publish is a Founding listing (section 13). Section 12 applies to a listing only once it has been paid for.

12. Paying, automatic renewal, cancelling and refunds

Paying. You pay by card through Stripe, the company that handles payments for us. We never receive or store your full card number. Each listing is its own yearly subscription, even when you buy several in one cart with one payment. You get a receipt by email.

If someone else lists the same website first. If another account publishes a listing for the same website address before your payment completes, your listing is not published and your payment for it is refunded in full automatically.

Automatic renewal. Each paid listing renews automatically for another year, every year, on the anniversary of its first payment, until you cancel it. On that date we charge the card on file for that listing the price for its plan shown on our pricing page at that time, less any volume discount your account qualifies for that day, plus sales tax where your state charges it.

The discount at renewal. The volume discount is worked out again at each listing's renewal, from the number of active listings your account has on that listing's renewal date. If your account has fewer listings by then, the discount can be smaller or gone. If it has more, the discount can be larger. For example, an account that has gone from ten Basic listings to seven renews each one at 15% off, which is $67.15 before tax.

Before each renewal. We email you a reminder, with the date and the price, at least 15 days before each listing renews. Seven days before the renewal date we run the website checks in section 6. If your website fails, we email you what failed and how to fix it, and we check again in the 24 hours before the charge. If it still fails then, we do not charge you and the listing is not renewed. We email you why, and the listing comes down when its paid year ends. Here, a check your web host turned away is not a fail. On its own, it never stops a renewal. If that happens, a person looks at your website before we decide.

If the price changes. If we change the price of your plan, we email you at least 30 days before your renewal. The new price applies from that renewal, and you can cancel before it.

If a renewal payment fails. The payment company tries the card again and emails you. If the payment still does not go through, the listing is not renewed and may come down.

How to cancel. You can stop a listing from renewing at any time:

  • online, from Your listings, under Billing; or
  • by writing to billing@websites4contractors.com from the email address on your account, naming the listing.

If you cancel after the first 30 days, the listing stays published until the end of the year you paid for, and then comes down. It does not renew, and no refund is owed for the rest of that year.

Cancel + Refund in the first 30 days. For 30 days after you first pay for a listing, you can use the Cancel + Refund button in Your listings, for any reason. It does three things at once:

  • it refunds that listing's own price: what you were actually charged for that listing after any discount, plus the sales tax charged on it;
  • it takes the listing down; and
  • it cancels that listing's subscription, so it never renews.

For example, if you bought ten Basic listings together at 25% off, each one cost $59.25 before tax. Using Cancel + Refund on one of them returns $59.25 plus the tax charged on it. Your other listings stay up and keep their price until their own renewal.

The refund goes back to the card you paid with. Your bank decides how quickly it shows, which can take several business days.

After 30 days. Cancel + Refund is no longer available, and a renewal payment does not start a new 30 days. If you think you are owed a refund after that, write to support@websites4contractors.com and a person will look at your request. We do not promise a refund after the first 30 days, except where section 14 or section 19 says so.

When Cancel + Refund does not apply. It does not apply to a Founding listing, because no payment was taken (section 13). It does not apply to a listing we have already taken down for breaking these terms (section 14).

Disputing a charge with your bank. Please write to billing@websites4contractors.com first. We can usually fix a problem faster than a bank can. If you dispute a charge with your card company instead, we may take the listing down while the dispute is open.

13. Founding listings

What a Founding listing is. While payments on Websites4Contractors are closed, you can publish a Basic listing without paying. We call this a Founding listing. We do not ask for a card. Before you publish, you confirm your account's email address by opening a link we email to you. A Founding listing is a Basic listing like any other: it has the same page, the same link to your website and one category, and nothing on the public pages marks it as free. Pro listings open when payments open.

What it will cost. When payments open, a listing costs $79 a year on Basic or $149 a year on Pro, plus sales tax where your state charges it. If you pick a plan on or before your last day (explained below), those are the prices for your first year. The discount for accounts with five or more paid listings applies the same way it does to any listing. After the first year, renewal works as our Terms of Service describe.

How long it is free. Your Founding listing stays free until payments open. We do not know that date yet, so we do not promise one.

How the free time ends. When payments open, we send one email to the email address on your account. It says that payments are open and names your last day to pick a plan. Your last day is at least 14 days after the day we send that email. The day we send it does not count. The days are counted from the day we send the email, not the day you open it, so keep the email address on your account up to date. We send a reminder 3 days before your last day. You can pick a plan at any time up to the end of your last day, wherever you are in the United States.

If you pick a plan. Your listing stays published the whole time. Its page never comes down, and it keeps the date it was first listed. From the day you pay, it is a paid listing like any other: it renews each year, and it has the 30-day Cancel + Refund, counted from the day you pay.

If you do not pick a plan. No earlier than the day after your last day, your listing goes back to a draft, and we email you to say so. Its page leaves the directory. Nothing is deleted: the draft stays in your account with its words and photos. You can publish it again later by picking a plan, at the price on our pricing page that day.

No payment, so no refund. You pay nothing for a Founding listing, so there is nothing to refund, and Cancel + Refund does not apply to it. You can take your Founding listing down yourself at any time from Your listings, the page you see when you log in. If you do, you can publish it free again only while Founding listings are still on offer.

Same checks, same rules. A Founding listing passes the same checks as a paid listing before it is published, and you make the same three statements about your business. While it is published it follows the same rules as any listing. Its link can be paused, and the listing can be taken down, for the same reasons as a paid listing. The rest of our Terms of Service apply to it too.

How many. One account can have up to 3 Founding listings published at one time.

What we can change, and what we cannot. We may stop offering new Founding listings at any time, and we will stop when payments open. That does not change a Founding listing you have already published: it keeps everything promised here. For a Founding listing that is already published, we will change these promises only to give you more time or to cost you less. We will not set a Founding listing back to a draft for having no plan while payments are closed on our side. If we have to close payments again after we send the email, we move your last day later by at least the number of days payments were closed, and we email you the new date.

14. Taking a listing down, and closing an account

You can take a listing down. You can take a Founding listing down yourself at any time (section 13). For a paid listing, you can use Cancel + Refund in its first 30 days or stop its renewal at any time (section 12). To take a paid listing down before its year ends, write to support@websites4contractors.com.

We can hold, pause or remove. We may refuse to publish a listing, hold an edit, pause a link, remove a photo or a category, or take a listing down, whether it is a paid listing or a Founding listing, if:

  • one of the three statements is false or has stopped being true;
  • the listing or its website breaks these terms, or the website no longer passes our checks;
  • someone with a right to complain tells us the listing breaks their rights, or a court or the law requires us to act;
  • a payment for it fails, is reversed or is disputed; or
  • we reasonably believe it is harming, or is about to harm, homeowners, other businesses or the directory.

We tell you by email what we did and why, unless the law stops us from telling you. If you think we got it wrong, write to support@websites4contractors.com and a person will look again.

Refunds when we take a listing down. If we take a listing down because it broke these terms, you are not owed a refund. If we end a paid listing for a reason that is not your doing, including if we close the directory, we refund the part of the paid year you have not used.

Closing an account. You may close your account at any time by writing to support@websites4contractors.com from the email address on the account. We may close an account that repeatedly or deliberately breaks these terms. Closing an account takes its listings down, and the refund rules above apply.

What lasts. The parts of these terms that are meant to last, such as the limits on what we owe each other and how disputes are handled, still apply after a listing or an account ends.

Reporting a listing. If you believe a listing is false, uses your business or your website without permission, or breaks these terms, write to abuse@websites4contractors.com and tell us which listing and why.

Copyright. If you believe something on the directory copies your work without permission, send a notice to our copyright contact below. United States law asks that the notice include your signature (a typed name is fine); the work you say was copied; where on our site the copy is; your contact details; a statement that you believe in good faith the use is not allowed; and a statement, under penalty of perjury, that the notice is accurate and that you own the work or act for its owner.

If we remove your content because of a notice and you believe that was a mistake, you can send a counter notice to the same contact, and we will follow the steps the law sets out. We close the accounts of people who repeatedly post content that breaks other people's rights.

16. What Websites4Contractors is, and is not

This section is for businesses and for homeowners.

  • We are a directory. We are not a contractor, and we are not part of any agreement between a homeowner and a business listed here.
  • We do not check licenses, insurance, bonding, permits, references or the quality of anyone's work. A listing is not our recommendation. If you are hiring, check a contractor's license and insurance with your state before you agree to anything.
  • Listings are written by the businesses themselves. We check them only in the automatic ways these terms describe.
  • We work to keep the directory running and correct, and we provide it as it is. We do not promise that it will always be available or free of errors, or that a listing will bring you customers, calls or search ranking. As far as the law allows, we make no other warranties, which are legal promises about quality, whether written or implied.

17. Limits on what we owe you

As far as the law allows:

  • We are not liable for lost profits, lost business, lost leads, lost search ranking or other indirect losses, even if we were told they might happen.
  • Our total liability to you for all claims connected with the directory is limited to the greater of (a) what you paid us, in the 12 months before the claim arose, for the listing or listings the claim is about, or (b) the price of one Basic listing for one year.

These limits apply to every kind of claim. They do not apply to anything the law does not let us limit, such as our own fraud or deliberate wrongdoing. They are part of the price: a listing costs what it does because our risk is limited.

18. If someone makes a claim because of your listing

If someone brings a claim against us because of your listing, your content, your business's work, a false statement you made to us, or your breaking these terms, you agree to cover our reasonable costs and losses from that claim, including reasonable legal fees. Lawyers call this an indemnity. We will tell you about the claim soon after we learn of it. You are not responsible for any part of a loss that we caused.

19. Changes to the directory and to these terms

To the directory. We may add, change or remove features. If a change takes away a main part of what a paid listing includes during a year you have already paid for, you may cancel that listing and we refund the part of the year you have not used.

To these terms. We may change these terms. When a change matters to you, we email you at least 30 days before it takes effect. A change to prices, or to what a paid listing includes, applies to a listing from its next renewal. Other changes apply from the date in our email. If you do not agree with a change, you may cancel before it takes effect. If a change takes effect before your paid year ends and makes things materially worse for you, we refund the part of the year you have not used.

The date at the top shows when these terms last changed. The promises in section 13 change, for a Founding listing already published, only as that section says.

20. Law and disputes

Talk to us first. If you have a complaint, write to legal@websites4contractors.com. You and we will each try in good faith to settle it within 30 days.

Which law applies. The laws of the State of California apply to these terms, wherever your business is.

Which courts. Any court case about these terms or the directory must be brought in the state or federal courts located in Riverside County, California, and you and we both agree to those courts. Either of us may instead use a small claims court that has the power to hear the claim.

21. Listings carried over from our earlier directory

If your business was listed on Websites4Contractors before these terms, we carried your listing over.

If you pay for it through PayPal, it keeps running through the time you have already paid for. While it is paid for, it counts toward your volume discount. At least 30 days before your next renewal, we will write to you about moving it to a Basic plan under these terms. The move is at the Basic price, paid through our checkout. One exception: if your next renewal comes less than 30 days after these terms were first published, it renews through PayPal as before. We will then write to you at least 30 days before the renewal after it.

If we carried your listing over at no charge, it stays up at no charge. If that changes, we will write to you at least 30 days before.

These terms start for a carried-over listing on the day you agree to them in your account here. If you agree to move it to a plan paid through our checkout before that, they start that day instead. Until they start, your listing keeps running as described above.

22. General terms

  • The whole agreement. These terms, our Privacy Policy, and what our pricing page and your cart showed when you bought are the whole agreement between you and us about the directory.
  • If part of it fails. If a court finds that part of these terms cannot be enforced, the rest still applies.
  • No waiver. If we do not enforce a term once, we can still enforce it later.
  • Transfers. You may not transfer your account to someone else without our written agreement. If the business on a listing is sold and stays the same business, write to support@websites4contractors.com and we will help its new owner take over the listing. We may transfer these terms to a company that takes over the directory, and we will tell you if we do.
  • Notices and records by email. You agree that we may send you notices and records by email and through your account instead of on paper.
  • Things outside our control. We are not responsible for a delay or failure caused by something outside our reasonable control.
  • Not partners. These terms do not make you and us partners, or make either of us the other's employee or representative.

23. Notice for California customers

Under California Civil Code Section 1789.3, California customers are entitled to this notice. The directory is provided by TRESYN LLC. Our charges are described in section 11. To make a complaint or to get more information, write to support@websites4contractors.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
